MEMBERSHIP TERMS & CONDITIONS

Membership Details 

Terms of memberships can be month-to-month,multi-month, or on an annual term basis. Specifics of Memberships will be communicated to the Member upon signup for services. Memberships may change prices and members will receive 30 day notice of any price changes. All memberships will be billed on the 1st day of the prior month. Any membership fees that are not paid within 10 business days may result in suspension and/or termination of the membership. Members are defined as any person or entity who enters into Gather Cowork including Day Pass Users and Member’s Guests. By signing up for a Membership, Day Pass, Meeting use, or Event use, Member agrees to these Terms & Conditions and Rules of Conduct.

The following memberships are offered by Gather Cowork:  

Mail Service 

  1. San Diego business address
  2. Mail handling
  3. Mail forwarding and scanning is subject to an additional fee.
  4. Package handling
  5. Physical signage for directory verification is available for an additional fee
  6. Access to mail service during regular business hours  

Part Time Coworking

  1. Ten (10) days of access monthly
    1. One (1) day is defined as up to 14-hour period from time of login.  
  2. One (1) hour of Meeting Room Credits
    1. Additional bookings are available on a per hour basis for an added fee. 
  3. Access to Private Call Rooms
  4. Hi-speed wifi
  5. Access to Member Amenities

Open Coworking

  1. Unlimited 24/7 access
  2. Three (3) hours of Meeting Room Credits
    1. Additional bookings are available on a per hour basis for an added fee.
  3. Access to Private Call Rooms
  4. Hi-speed Wifi
  5. Access to Member Amenities
  6. Address usage. 
    1. Physical signage is subject to an additional fee.

Day Pass

  1. Everything included in the Open Coworking Plan plus:
  2. Day pass ends at 11:59:59 pm of the day that it is purchased.
  3. Note: Does not include Meeting Room Credits

Dedicated Desk

  1. Everything included in the Open Coworking Plan plus:
  2. Three (3) additional hours of Meeting Room Credits (6 total)
    1. Additional bookings are available on a per hour basis for an added fee.
  3. Dedicated adjustable standing desk with monitor, docking station, and mouse.
  4. Secured overnight storage 

Private Offices 

  1. Everything included in the Open Coworking Plan plus
  2. Small Private Office: 2-3 persons
    1. Five (5) additional total hours of Meeting Room Credits (8 total)
    2. Additional bookings are available on a per hour basis for an added fee.
  3. Large Private Office: 4-6 persons
    1. Seven (7) additional total hours of Meeting Room Credits (10 total)
    2. Additional bookings are available on a per hour basis for an added fee.
  4. Secured overnight storage 

Meeting Room Credits

  1. Meeting Room Credits can be sold standalone. All terms and conditions stated within apply.
  2. Conference & Event Room bookings eight (8) hours or more require a non-refundable deposit equivalent to two (2) hours of use. If notice of cancellation is received within 24 hrs of the start of reservation, a credit, may be given for use at a future date.

Dedicated Desk Reservations 

  1. Dedicated Desks are reservable via our website at an additional charge per membership tier below. This feature is available if Dedicated Desks are available for the day.
  1. Day pass members: $20 add ($45 total per day)
  2. Coworking members: $10 additional per day

Refund Policy 

Gather Cowork will not issue refunds unless otherwise noted.  

Under special circumstances, arrangements be made to pause or postpone memberships; however, no refunds will be issued. Please speak to the Community Manager if you have questions or concerns.

Internet Policy  

Gather Cowork makes no representations or warranties whatsoever as to the security of the internet provided as part of membership, including, but not limited to, wired or wireless telecommunications systems, hosting services provided as part of the Services, or of any data or communications system or any information that the Member sends through or places on it, and Members shall have no expectation of privacy with respect to such systems. Member shall not send malware or viruses nor shall Member attempt to collect personally identifiable information from other Members or entities using Gather Cowork facilities. 

Gather Cowork is not responsible for any loss of data, information, business, goodwill or otherwise as a result of such interruptions. Members are responsible for protecting their own computers, devices and data, information, business and goodwill from damage or interference, including but not limited to, viruses or malware. If Members are found to be violating this policy, Members may be automatically removed from the network. 

Privacy Policy 

We may collect, process and/or use personal data about Members in a variety of ways, including personal data that may be provided by Members upon execution of this Agreement or during Membership, and information that may be gathered from our security cameras located on the premises. We may collect, process, use, store and transfer personal data in accordance with applicable laws, for various purposes including facilitating the Services, perform accounting and administrative tasks, internal review and audit, compliance with obligations under applicable laws and regulations, to enforce or manage legal claims and otherwise in accordance with the Internet Policy. For the purposes stated above, we may transfer the personal data collected by us and make it available to our personnel, advisors, professionals, subcontractors, independent consultants, external third-party services providers, and our affiliates.  For full terms of our Privacy Policy, please visit https://gathercowork.com/privacy-policy/ or ask for a hard copy from the Community Manager. 

Right to Suspension or Cancellation 

Please note that Gather Cowork has the right to suspend or cancel a membership at any time for and for any reason. Termination for cause due to cause such as breach of Terms and Conditions, violation of policies, violation of Rules of Conduct, unlawful activity, etc. may be subject to immediate termination without written warning. Otherwise, Members will receive a written warning before suspensions or cancellations are affected.

All memberships, unless stated otherwise, Month-to-month membership cancellation or change requires 30 days’ notice. Annual membership cancelation or change requires 60 days’ notice. 

Members using our commercial mailing address for registry on digital platforms that require a physical business address and/or address verification such as Google My Business, will be required to remove our address from their listing before terminating the membership. Failure to remove the listing will result a monthly Membership charge until Member removes the mailing address and/or address verification.  

Meeting Room reservations will not be refunded if canceled within 48 hours of reservation.

Event Room reservations will not be refunded if canceled within 72 hours of the reservation.

No Unlawful or Prohibited Use 

Members agree not to use the Gather Cowork Premise for any purpose that is unlawful, prohibited, is a nuisance, prevents other Members from enjoying the Coworking Space, that would damage the reputation or business of Gather Cowork, or that could damage or impair the property of the Gather Cowork, its landlord, other building tenants or of other Members.

By accepting these terms and conditions Members confirm that they have received, read and understand these all terms and conditions. Members accept these Rules of Conduct (as listed below) and Conditions. Violations of the Terms or Rules of Conduct may result in immediate termination of Membership. 

Waiver of subrogation, indemnity, and hold harmless

Gather Cowork carries liability and business property insurance; however, Members are encouraged to carry an insurance policy to cover Member equipment and personal property while using the premises. Any Member with dedicated office space shall be required to have a general liability policy to cover any injury or loss to its members or guests. 

Members & Guests waive any right of subrogation and right of recovery or cause of action for any damage or theft, destruction, or loss of property, or any injury including death to the extent the same is insured against under any insurance policy which Members may have.  

Member acknowledges that Gather Cowork is not providing guard service, or any other security measures regarding the Premises used under the terms of this agreement. Member agrees to defend and hold harmless Gather Cowork from any claims arising out of, or pertaining to, the safety or protection of the Member, its agents, employees, and invitees from acts of third parties. Further, Member assumes responsibility and covenants to defend, indemnify and hold harmless Gather Cowork from any responsibility for loss or destruction to personal property or injury to person of Member, any of Member’s employees, agents, and invitees due to theft, vandalism, and crimes, or any other similar act.

Member agrees to defend, indemnify, and hold harmless Gather Cowork from and against any and all claims and causes of action (whether in contract or in tort) arising out of or connected in any way to the premise and the Member’s use thereof, or Gather Cowork’s operations. This includes (without limitation) all claims,  losses, expenses, costs, judgments, and/or demands for injury (including death), liability, damages, loss or damage to property, fines, and penalties (including costs of attorneys’ fees and similar expenses). Member’s agreement to indemnify Gather Cowork does not apply to any liability which is the direct result of the sole active gross negligence, or willful conduct of Gather Cowork, its members, contractors, agents, invitees, or its employees.

Property and Damages

Members will be held responsible for any damages caused by them or their guests, and may be required to pay for any necessary repairs or replacements. This includes but is not limited to, furniture, equipment, walls, flooring, and any other property belonging to the Coworking Space. Members shall report any damages immediately to the Community Manager. 

Changes and Questions

Gather Cowork reserves the right to make changes to Terms & Conditions at any time. If you have any questions about any of these terms or how to comply, please contact the Community Manager.

Shipping / Fulfillment policy

We do not ship any physical products from Gather Cowork. All keys / fobs are to be picked up in person. All keys and fobs must be returned at the end of the membership. Unreturned keys/fobs are subject to additional fee.



Payment Types

We accept Visa, Mastercard,American Express, ACH and checks. Additional payment types may be accepted on a case by case basis. Should the collection of Member’s payment be declined or not received by the billing date, Member will have 15 calendar days from the time of notice to reconcile the payment. If payment is not reconciled within this reasonable time frame, the payment is subject to an additional penalty fee of 15% and/or termination of Membership.

Rules of Conduct

We are committed to providing our members with a top-quality, safe Coworking experience. For the comfort and enjoyment of all our members, we ask that Members abide by our Rules of Conduct in the following categories.  

Dress Code 

All private body parts should be sufficiently covered while on the premises at all times. Please be respectful of others and dress professionally. 

Eating 

We are happy to provide all our members with complimentary tea, coffee and water and a variety of snacks. To keep our workspaces neat and clean, all food that is hot or odorous must be consumed at the small tables in the kitchen area. Other foods, beverages in sealed bottles, cups with a lid may be consumed in the Coworking Space, but please be mindful of Members eating and clean up after themselves. Members are expected to clean up personal plates, cups, and cutlery after using them.  Please alert a staff member if any supplies are missing or need to be replaced.

The fridge is for the Members to use and keep their perishable food. The fridge will be cleaned, and any food will be disposed of every Friday evening.  Please make sure be sure to remove any dishes and food before then.  

Noise 

Please keep noise levels to a minimum. Phone calls may take place in Coworking Spaces and common areas. It is expected that phone booths are used for calls longer than 5 minutes out of respect for fellow Members. Private conferences should occur in Meeting Rooms during Member’s reserved period. 

We encourage Members to communicate with their workspace neighbors and let them know directly if their noise levels are too loud.  

To eliminate outside noise, we may play music or white noise in our space, at our discretion. We thank Members for their feedback and music suggestions as we create a comfortable and stimulating Coworking environment.  

Private Call Room

Private Call Rooms are available to all Members. Use of Private Call Rooms are limited 60 minutes when all Rooms are in use. 

Member Access 

Staffed hours are typically Monday through Friday from 9 am until 3 pm, and 24-hour access is available. However, please do not bring guests or clients after hours without first checking in with a Gather Cowork staff member. We are not liable for Member’s loss or damage to Member’s possessions and encourage Members to act responsibly and respect the space. Please note that 24-hour security surveillance is in effect.  

Guest Policy 

Guests are defined as non-members. Guests may also be clients of Member. Guests are only allowed for Members with Private Office Memberships or for Meeting Room Bookings. Quantity of guests is limited to the maximum occupancy of the Private Office or Meeting Room.  Members shall assume responsibility for their guests. A guest’s attendance duration is limited to the time of the Meeting Room booking, where applicable, or maximum four (4) hours for Private Office or at the discretion of Gather Management. 

Members will be charged a discounted day-pass for Guest’s who exceed the limits described previously. Wi-Fi usage can only be granted to the guests by an administrator. We ask that members alert the Community Manager ahead of time that they are expecting guests. Gather Cowork is not liable for loss or damage to Guest’s personal property or bodily injury to Guest.  

Animal Policy

Not pets including, but not limited to, dogs, cats, lizards, fish, birds, are not allowed on premises with the exception of service animals and approved support animals. 

Events (Personal Use)

One of the perks of membership with Gather Cowork is usage of the private meeting rooms for meetings. Should Members wish to arrange for a larger event, we encourage Members to let the Community Manager know in advance. We are happy to reserve portions of the Coworking Space for Members business either during or after hours for a fee. If the event is to take place during normal staffed hours, please let us know in advance so that we can make accommodations with the other Members.  

Members may reserve space for events in which they charge participants, only after speaking with the Community Manager for permission. Evidence of insurance is required. Members who host paid events and wish to serve alcohol are responsible for following all federal, state, and local laws. Gather Cowork is not liable for unlawful serving of alcohol or for loss or damage to personal property.  

Address Usage 

Members are invited to use our mailing address for business purposes when they enroll for monthly membership (except for Part Time). Please inform the Community Manager that you would like address usage and s/he will assign Members a mailbox (located in the Front Desk area).  Incoming mail may be received here, but outgoing mail should be mailed from the post office.  

Personal Conduct

Members are responsible for the conduct of themselves and their guests. Any harassment, discrimination, bullying, abusive conduct on the part of any Member, their guest shall not be tolerated and may be grounds for immediate termination of Membership. Gather Cowork does not tolerate discrimination or harassment on the basis of race, color, religion, veteran status, national origin, ancestry, pregnancy status, sex, gender identity or expression, age, marital status, mental or physical disability, medical condition, sexual orientation, or any other characteristics protected by law.

Printing Allowance 

All Gather Cowork members may use the printer and copy machine for an additional charge. See Community Manager for current rates. Usage is tracked through an internal software. Gather Cowork regularly supplies standard letter size (8.5” x 11”) white paper. Members may load their own paper if they require other colors besides white or sizes other than letter. Please speak to the Community Manager if you have any questions.  

Meeting Room Credit 

Members have an allowance of Meeting Room bookings in their account. Allowance includes usage for short private conferences or meetings of up to 10 minutes as the space allows. For longer meetings, members must reserve the room using the booking software. Please be mindful of your usage and clean up after yourself so that other members may utilize the space as well. Usage is noted and maintained on our online booking calendar. Once a member’s allowance has been consumed, conference rooms can be booked on an hourly basis for an additional fee.  

Cleanup: Members are expected to book Meeting Rooms in advance of use using their Credits. One (1) Credit equals up to an hour of use. Partial credits are available currently. Monthly credits do not rollover. If Member or non-member leaves Meeting Room in a state that requires extensive clean up, Member shall be charged a $50.00 cleaning fee. Any significant damage caused by Member or Member’s guest to Meeting Room shall also be charged to the Member. Members are encouraged to report any damage as soon as possible to the Community Manager. 

Camping 

Under no circumstance will camping be permitted. We are open to paying Members 24 hours per day, but night-time usage should be confined to night work (not sleeping or squatting, etc). Please note that the facility is under 24-hour video surveillance. 

 

Smoking & Vaping 

Smoking, vaping, or illegal drug use is prohibited inside the building.

Storage

Members shall provide their own locks for use of the Lockers. Keys shall be returned to Gather Cowork at termination of memberships provided with secured storage. Failure to return keys will result in a $25 Lock Change Fee.

Photography & Videography

Photography and videography for commercial purposes is prohibited without written permission. This rule is in place to protect the privacy and intellectual property rights of our members. We understand that some members may need to take photos or videos for their personal use, but we ask that you do so with discretion and respect for others’ privacy. If you wish to use our space for commercial purposes, please contact the Community Manager to obtain permission.

Personal Property

Members are prohibited from using other members’ personal property without their permission. This includes but is not limited to, office supplies, furniture, electronics, and any other personal belongings. We understand that accidents can happen, but we ask that you treat other members’ property with care and respect. If you need to borrow something from another member, obtain their permission first. Any violation of this rule may result in disciplinary action, including termination of your membership.
